(GenBio), Ventana Growth Fund (Ventana), and Thomas Gephart. GenBio, Ventana, and Gephart cross-appeal the trial court's dismissal under Rule 41(b) of their claim that Condie and Yarter breached their fiduciary duties as directors of GenBio. 3 We affirm.
